Terms of service
Effective from: 13.05.2026
This document defines the rules for concluding sales agreements through the Fresso online Store, including important information about the Seller, the Store, and the rights granted to Consumers. The Store is powered by Shopify technology, which allows us to provide online e-commerce services to Buyers.
§ 1 Definitions

Business Days – days from Monday to Friday, excluding public holidays in Poland.

Civil Code – the Polish Act of April 23, 1964 – Civil Code.

Consumer – a Buyer who is a natural person, purchasing from the Store or taking steps toward a purchase, with no direct connection to their business or professional activity.

Account – a digital service within the meaning of the Consumer Rights Act, regulated by separate terms, enabling the Buyer to use additional features in the Store free of charge.

Buyer – any entity purchasing from the Store or taking steps toward making a purchase.

Privileged Buyer – a Consumer or a Privileged Entrepreneur.

Privileged Entrepreneur – a Buyer who is a natural person concluding or intending to conclude an agreement with the Seller based on these Terms and Conditions, directly related to their business activity, but where the agreement does not hold a professional character for them.

Terms and Conditions – these regulations.

Store – the Fresso online store run by the Seller at https://fresso.pl.

Seller – DAMIAN STEFAN FIGARSKI, an entrepreneur conducting business activity under the business name FRISTO Damian Figarski, NIP (Tax ID): 9522173106, REGON: 369205868, ul. Żegańska 21/23, 04-713 Warszawa, Poland.

Services – any information, content, features, tools, products, and services offered by the Seller through the Store to provide the Buyer with an online shopping environment.

Consumer Rights Act – the Polish Act of May 30, 2014, on Consumer Rights.
§ 2 Contact with the Seller

The cost of a telephone call or data transmission made by the Buyer results from the basic tariff of the telecommunications operator or internet service provider used by the Buyer.

The Seller notes that the cost of an international call or international data transmission may be higher than the cost of a domestic call or transmission – depending on the tariff applied by the telecommunications operator or internet service provider used by the Buyer.
§ 3 Technical Requirements

For the proper functioning of the Store, the following are required: a device with internet access and an internet browser supporting JavaScript and cookies.

To place an order in the Store, in addition to the requirements specified in paragraph 1, an active e-mail account is necessary.
§ 4 Purchases in the Store

Product prices visible in the Store are total prices for the product.

Omnibus Directive: In the case of displaying a product price reduction, alongside the information about the reduced price, the Seller also displays information about the lowest price of that product that was in effect during the 30-day period prior to the introduction of the reduction.

The Seller notes that the total price of the order consists of the price for the product indicated in the Store and, if applicable in a given case, the delivery costs of the goods.

The product selected for purchase must be added to the shopping cart in the Store.

Next, the Buyer selects the method of delivery of the goods and the payment method for the order from the options available in the Store, and provides the data necessary to complete the placed order.

The order is placed at the moment its content is confirmed and the Terms and Conditions are accepted by the Buyer. Placing an order is equivalent to concluding an agreement between the Buyer and the Seller.

The Buyer can register in the Store, i.e., set up an Account, or make purchases without registration by providing their data with each potential order.

The Seller has made every effort to present the products in the Store accurately. However, it should be noted that the colors and appearance of the products may differ slightly depending on the type of device and its display settings.

The Buyer represents and warrants that all information provided in connection with the placed order is correct, up-to-date, and complete.
§ 5 Payments

The following payment methods are available in the Store:
-
Standard bank transfer to the Seller's bank account.

By payment card: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

Via the payment platform: PayPro / Przelewy24.
-
Cash on delivery (COD), i.e., by card or cash at the time the goods are delivered to the Buyer.

If the Buyer selects advance payment, the order must be paid for within 7 Business Days from placing the order.

By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw their acceptance.

If it is necessary to refund funds for a transaction made by the Buyer with a payment card, the Seller will issue the refund to the bank account assigned to the Buyer's payment card.

The entity providing online payment services for fast transfers is PayPro S.A.
§ 6 Order Processing

The order processing time is indicated in the Store.

If the Buyer selects payment by bank transfer or payment card, the order processing time is calculated from the day the Seller's bank account or settlement account is credited.

In a situation where the Buyer has purchased products with different processing times within one order, the order will be processed within the timeframe applicable to the product with the longest processing time.

Goods are delivered exclusively within the territory of the Republic of Poland.

The following delivery methods are available in the Store: via InPost and DPD courier companies, to InPost parcel lockers, and to DPD Pickup points.

All delivery dates given in the Store are estimates. The Seller is not liable for delays caused by carriers or events beyond the Seller's control.

Uncollected shipments: In the event that a shipment is not collected by the Buyer and is returned to the Seller (e.g., due to an incorrect address or failure to collect on time), the Seller may contact the Buyer to arrange re-shipment, which will take place at the Buyer's expense.
§ 7 Right of Withdrawal from the Agreement

A Privileged Buyer has the right to withdraw from the agreement concluded with the Seller through the Store, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.

The withdrawal period expires 14 days from the day on which the Privileged Buyer took possession of the goods or on which a third party other than the carrier and indicated by the Privileged Buyer took possession of the goods.

To exercise the right of withdrawal, the Privileged Buyer must inform the Seller, using the data provided in § 2 of the Terms and Conditions, of their decision to withdraw from the agreement by means of an unequivocal statement.

The Privileged Buyer may use the model withdrawal form located at the end of the Terms and Conditions, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for the Privileged Buyer to send information concerning the exercise of their right of withdrawal before the withdrawal period expires.
Effects of Withdrawal from the Agreement

In the event of withdrawal from the concluded agreement, the Seller returns to the Privileged Buyer all payments received from them, including the costs of delivery (except for additional costs resulting from the Privileged Buyer's choice of a delivery method other than the least expensive type of standard delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Privileged Buyer's decision.

The Seller will issue the refund using the same payment methods used by the Privileged Buyer in the original transaction (including via the Przelewy24 system), unless the Privileged Buyer agrees to a different solution.

Unless the Seller has offered to collect the goods themselves, the Seller may withhold the refund until they have received the goods back or until evidence of having sent back the goods has been supplied.

Address for product returns: The Seller requests that goods be returned to the logistics center address: Point of View, Łubińska 14, 05-532 Łubna, Poland, immediately, and in any case no later than 14 days from the day of informing about the withdrawal.

The Privileged Buyer bears the direct costs of returning the goods.
-
The Privileged Buyer is only liable for any diminished value of the goods resulting from handling them other than what was necessary to establish the nature, characteristics, and functioning of the goods. Please return goods showing no signs of use.
§ 8 Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to an agreement:
-
where the subject of the performance is non-prefabricated goods, manufactured according to the Privileged Buyer's specifications or serving to satisfy their individualized needs;
-
where the subject of the performance is goods that spoil rapidly or have a short shelf life;
-
where the subject of the performance is goods delivered in a sealed package which cannot be returned after opening due to health protection or hygiene reasons;
-
where the subject of the performance is goods which, after delivery, according to their nature, become inseparably mixed with other items;
-
where the subject of the performance is sound or visual recordings or computer software delivered in a sealed package, if the package was opened after delivery;
-
for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts;
-
where the price or remuneration depends on fluctuations in the financial market over which the Seller exerts no control.
§ 9 Complaints
I. General Provisions

The Seller bears liability toward the Privileged Buyer for the compliance of the performance with the agreement as provided for by universally binding provisions of law.

The Seller requests that complaints be submitted to the postal or electronic address indicated in § 2 of the Terms and Conditions.

The Seller will respond to the complaint within 14 days from the date of its receipt.
II. Privileged Buyers – Goods

The Seller is liable for any lack of conformity of the goods with the agreement that becomes apparent within two years from delivery.

In the event of a lack of conformity with the agreement, the Privileged Buyer may demand repair or replacement of the goods.

Additionally, they may submit a statement on price reduction or withdrawal from the agreement in the cases specified in the Act.

In the event of withdrawal from the agreement, the Privileged Buyer immediately returns the goods to the Seller at the Seller's expense to the address: Point of View, Łubińska 14, 05-532 Łubna, Poland.
III. Out-of-Court Dispute Resolution

The Consumer may use the assistance of the European Consumer Centre, the ODR platform, or mediation conducted by the Voivodeship Inspectorates of the Trade Inspection.
IV. Buyers Other Than Privileged Buyers

Toward such Buyers, the Seller is liable under the warranty rules (rękojmia) on the principles set out in the Civil Code.

If it is necessary to deliver defective goods to the Seller, they must be sent back to the address: Point of View, Łubińska 14, 05-532 Łubna, Poland.
§ 10 Personal Data

The controller of personal data is the Seller.

The basis for processing is the performance of the contract, legal obligations, and the legitimate interest of the Seller.

Providing data is voluntary but necessary to conclude the agreement.

The Store is powered by Shopify technology, which collects certain data to provide its services. Details: https://privacy.shopify.com/pl.
§ 11 Intellectual Property

All content available in the Store constitutes the property of the Seller or its licensors and is protected by law.

It is prohibited to copy, modify, or distribute materials without prior written consent.
§ 12 Prohibited Uses
It is prohibited to use the Store for unlawful purposes, to harass other people, to transmit viruses, or to impersonate other entities.
§ 13 Shopify Platform
The Store is powered by Shopify technology. Shopify is not responsible for any aspect of the sale between the Buyer and the Seller.
§ 14 Changes to the Terms and Conditions
The Seller reserves the right to change the Terms and Conditions for important reasons (e.g., changes in law, changes in the Store's functionality).
§ 15 Miscellaneous

Agreements are concluded in the Polish language and are subject to Polish law.
